We are terminating an incompetent employee, who has worked for us for almost 6 month. The employee has received written evaluation and verbal and written warnings. As a religious organization we are exempt form State unemployment:
-Can the employee claim unemployment with the EDD?
-If yes, should we oppose her receiving unemployment compensation?
-If we do not oppose, where is this money coming from?
Thank you for your input.

It is my inderstanding that if employee is discharged for cause, they are not entitled to unemployment unless you wish to not contest. As far as how EDD claims works because of your company situation should the employee be considered to receive benefits, I would think that is a question for EDD.
