Minimum wage increase 2008 Expand / Collapse

If our pay period ends in December 2007 but our payroll date is the first payday January 2008, do we need to apply the new minimum wage to that January 2008 payroll or is that not applicable until the pay period dates are also reflecting January? I'm assuming that since payroll tax is based on a "cash" basis that we would apply the minimum wage increase requirement to the first pay day in January 2008?

Our payroll service, IBS, just told us to use the old rate if the time worked was in 2007.

Yes and days actually worked on 1/1/08 need to be paid at the new minimum. We pay bi-weekly here and it just so happened that one week was in 2007 and one was in 2008. To make it easier on our payroll we just back dated the increase to the beginning of the pay period. There weren't that may people affected by the increase so it was easier for us.
