If an employee calls in sick, but does not voluntarily tell me what is wrong with him/her; do I have the legal right to ask the employee what is wrong without violating privacy and HIPPA?

If the employee volunteers that info, you will not be out of compliance. However, if you ask, the employee may be able to claim is as discrimination in case that employee is ever terminated. You can ask the employee to submit a doctor's note excusing the absence for the illness. The doctor will not disclose the type of illness on the note due to HIPAA regulations. I hope this helps
