| I just found out about a comment that was made from one employee to another essentially calling her obese in a room full of other employees. No one has filed a complaint but this behavior is obviously not acceptable. As the HR of the company am I required to do or say anything to this manager since no one has come forward to say anything?

You should investigate this behavior even though a complaint has not been filed.
You are in a situation where several employees are aware of thte incident, and if you do nothing now, you are damaging the reputation of the company and inadvertently telling employees that this type of behavior is o.k.

| Is obesity a protected class? I don't think it is, but I could be wrong. I think either way it would benefit moral if you did do an investigation and perhaps council your staff (and specifically the "offender") on respect for their co-workers. In our office casual remarks are made all the time and every once in a while, someone's feeling get hurt. Bringing to light that what was said actually hurt or offended someone leads to resolution and a little more sensitivity to the topic in the future.
