I just took over employee mgmt. I have employee's that have filed with the Labor Board. They are claiming no breaks and not being paid OT.
The breaks I don't think I will have a problem with, but for the OT, here is my problem.
The employee's were permitted to work over their 8 hrs in one day, so they could still fullfill their 40 hrs and take classes. This is not in writing and they are saying that that is not the case. How do you fight something like this? Has anyone else had the same problem? I am also worried that if I loose the OT I may loose the breaks.

| Do you have any other workers that have worked under the same circumstances and can refute the claims being made?

I did find other employee's that had the same circumstances, so this will help greatly. Thanks so much for your idea. What should I do in the future? Should they fill out a schedule change request every payperiod, daily, weekly or what would be best? I am also concerned that they will take classes, then not let me know when they are out of class. I am trying to think ahead to keep from having any more problems.

Hopefully, you are still checking your posting. We established a Makeup Policy that effects all of our Hourly EEs. The Policy allows EEs to make up time by working over their 8 hours. Those hours are not considered OT. The request will need to be made before they are actually going to do it. Management cannot suggest it, encourage it or solicit it. There is more to it but I think it will help you in the future with dealing with this.
