We have an IT employee who has been diagnosed with an emotional disorder and has a wife who is currently going through a difficult pregnancy. We have made every attempt to accommodate this by allowing him to leave whenever there is an emergency, which everything has become an emergency. In has last review in March, he was informed that his productivity level was not up to par. Last week, his lack of follow-through resulted in our main server crashing. We have written him up, but want to state that the next disciplinary action could be suspension and/or termination. However, since he has this emotional disorder, could he file a wrongful termination suit? Any thoughts on how to handle, would be appreciated. Thank you!
