FMLA and disability leave - paid and unpaid Expand / Collapse

Our current policy pays FMLA time as disability pay if they qualify. The trouble is the employee and doctor do not submit the medical certificaiton in a timely manner to make our payroll deadlines. Can we classify the time as "unpaid" FMLA/disabilty until we get the certification?
