I work for a company that allows sales employees to only pay $100.00 per month toward their Medical Insurance premium but the rest of the staff has to pay 40% of their premium. Is this considered discrimination against general staff employees? It's very unfair the way this works because our medical premium goes up every year about 10 - 15%. The sales staff premium payment never increases but the rest of the staff has to pay 40% of the increased premium. Most of the sales staff are older in their 50s-60s and require more medical attention, thus making our premiums go up every year. they make more money than anyone else in the company and practically get their medical benefits for free. The rest of the staff has to pay out about $185.00 per month. Is this considered discrimination? Is this legal?

Any response is appriciated.

Thanks,
Tina

I believe it is. Our company has certain employees that have negotiated a flat rate or fully paid by the company. Of course our company is non union and the same goes with pay. Employees can always negotiate a high pay but they have the job work to justify raise. For employee only our rate is also 160 for medical. Medical is just at a high cost for everyone.

Employers can offer paid benefits as a form of a raise. Several people in our company have fully paid benefits as a part of their negoitated salary and this was offered in lieu of a raise or part of a raise.
