I have an employee that works 32 hours a week and says that California considers this full time. Our Vacation pay policy says an employee must be full time to earn vacation pay but we consider full time as 40 hours a week. Full time employees earn 40 hours a year because they work 40 hours a week. Its not fair to give 40 hours of vacation pay to those that work only 32 hours a week when others have to work 40 hours a week to earn their vacation time. This is why the policy was put into place. What are your views on this issue? Does CA consider 32 hours a week full time?

| Not sure about vacation, but with the medical and dental benefits if the employee works 30 hours or more a week, we must offer them benefits.

Your vacation policy is your own; the company is the one who sets the guidelines for policy. So if your policy states that a person has to work 40 hours a week then you are not obligated to sway from that.
CA does consider 32 hr or more full time for the purposes of benefits.
You may in this type of case pro-rate the vacation hours for persons’, who work 32 hours, or what your company considers part-time; according to the hours they do work.
We pro-rate according to their hours and rank.
