I am concerned that Mgmt may have made a bad choice in the handling of a recent WARN event and I could very well get mired in this. If would please advise, Thank you.

* 60 day notice given
* Employer gave notice, then reduced wages to 100 workers.
* Although employer is paying these reduced wages thru the end of the 60 days, the project/plant has effectively ceased operations 20 days after notice was given.

Question one: Should we not have provided the workers notice of the significant pay reduction prior to giving them their 60 day WARN notice? Giving them a chance to accept or reject? It appears to me that the reduction in pay was co-mingled with WARN to confuse and I do not feel comfortable with that. The law and spirit of it appears to read that notice should be given so that the individuals can make adjustments, seek work and so forth. - Please advise, I feel horrible. They lost 50% of their pay. We pay them for 40 hr weeks, but reduced.

Question two: Even though we are paying them through the end of the 60 days,production has effectively ceased. Should we not have provided them the notice 45 days earlier?
