Must California employees be reimbursed for mileage at the IRS rate? What are the rules regarding mileage reimbursement - Federal and State?

Actually, I had a job once as a commission salesperson where I stupidly didn't KNOW to make sure my contract said "at the current IRS rate or better" and they gave me a fixed mileage rate which I accepted, not realizing how high the IRS rate had gone up and, so, I totally lost out! I was getting reimbursed about 15 cents less per mile than the current year allowed. I totally ate it on that job, and I'm SO glad I don't work there anymore, or as a salesperson! So...I happen to know it can be whatever the two of you agree. The IRS just sets a number b/c people have demanded they do so.
