I noticed this morning that one of my employees has not been having any state or federal taxes withheld. I have not heard back from my payroll department yet. I don't know if payroll set him up incorrectly when he was hired in July, or if that is correct.

If he should have had taxes withheld to this point...how do we correct it? Do we have to now withhold back taxes from him...do we have to pay it for him...are there any penalties we could be subject to?

Perhaps it would behoove you to check his current W4 and State withholding to see what he instructed PR to withhold or not withhold for state and federal; if you don't have a current instructions on those form for 2010, obtain them from the employee. FICA (SS and medicare) and CA SDI are the mandatory tax withholdings.
