9/80 Alternative Work Week Expand / Collapse

Hi all. First and foremost thank you for any input you may have.

The employer is looking at implementing a 9/80 compressed work week for a variety of reasons most of all to benefit the employee. I have researched all material on this site and others and have not been able to answer a few questions and was hoping maybe some of you know the answers.

1. I understand the employees need to vote on whether they would like a 9/80 work week and that it must pass with two-thirds vote. What is the purpose of the vote? If there is a two-thirds agreement does that alleviate the employer of any overtime obligations? From everything I can read I cannot find the answers to those questions although I am construing that voting does not alleviate overtime constrictions.

2. Have any of your organizations implemented 9/80 work weeks for the masses? For workflow purposes we cannot have everyone off Mondays or Fridays or even half the staff off those days so we would want to stagger it Monday through Friday. I have seen all examples given of Mondays or Fridays being the day off but do you know of any reason why it couldn't be other days during the week? I cannot seem to find any reason it couldn't be but wanted reassurance.

3. Did any organization going to 9/80 work weeks need to change their payroll schedules to get around overtime issues IF voting does not alleviate the requirement? I.e. this employer pays on the 15th and last day of the month and if either of those days fall on a weekend, pay day is the Friday before. For this coming payday, the period for non-exempt staff is 3/25-4/11 which is 96 hours rather than 80.

Any help or advice is appreciated.
