Undocumented Employees Expand / Collapse

I just came on board with my Company a month ago. While I was going through I-9's and personnel files to make sure we were in compliance, there were a few employees that had expired resident cards. One employee admitted that he couldn't renew for whatever reason and wasn't able to get a new one. His card had expired since 2007 and he continued working, because no one followed up. I suspended him today and told him he had 10 days from today to renew or provide documentation that the process has started and we would reinstate him.
My transportation Manager told me to run all of driver's social to make sure we were in compliance. He said per TSA, all of our Class A driver's need to be in compliance with INS laws. TSA does random checks on truck drivers to check their paperwork, so if they run one of driver's and their papers are not legal or up to date, our company will be fined.
So I ran all of driver's and one driver appeared to have used someone's identification to get their work visa because the background said he was a registered sex offender in Indiana and the picture online does not match our employee.
Can I suspend him also or should I be calling a lawyer on this?? I haven't spoken to the employee yet...
