Can we have someone do an hour or two of work as the interview? Our true test is how well the work can be done and personality. If it is legal to do that - do we have to pay them?

Interesting question and I don't know if you actually have to pay them.

But I DO know you don't have to pay them much: there is a provision for training pay at 85% of minimum wage, but at no rate less than $6.80/hr. (See IWC Orders sec. 4) Seems to me you could pay them under that.

I mean, how much are you intending to be out of pocket of somebody doesn't work out? $13.60? If you're a sole proprietor, it costs you that much for them to open the front door.
