I was getting ready to discipline an employee for personal phone call abuse. I just found out over the weekend, the owners son (also an employee of ours) was at the offending employees house (he is friends with her significant other) and advised the employee she is abusing and taking advantage of us with her excessive personal phone calls. I am also going to guess there was alcohol involved as well but don't know this for sure. I am the personnel manager and I was going to deal with the abuse (not the first time we have addressed it) by putting her on probation this week as she has already been warned and told if she didn't fix the problem she would be 1) put on probation 2) then terminated. Question, could what the bosses son did be viewed as harrassment and should I call my attorney? Are my efforts to discipline her compromised now? If not, how should I procede? Should the bosses son be disciplined for doing this? He was not asked to do this nor does he have any roll in staffing or hr. He took it upon himself to handle and address. Any suggestions will be wonderful! Thanks.

Be sure that you address it and document it, no matter what the son's position. If the son truly is in a position of management over that individual, pull him in so you can offically document his conversation to the employee. If he is not, have an additional and separate discussion with him about what is appropriate and what is not appropriate conversation outside of the workplace. Be sure that you have the owner on your side before you have this conversation. Having family members of management employed makes thinks sticky sometimes. Be sure to let the owner know that you will be documenting the conversation with the son.

Documentation and following your own policy/practice with regard to discipline are very important, as noted in the previous comment.
